Purpose. This article analyzes the problems of theory and practice of applying criminal law norms on responsibility for giving and receiving bribes. A special subject of malfeasance is analyzed. Scientific novelty. An author's position is expressed related to the improvement of criminal law in the sphere of responsibility for giving bribes to persons holding public office in the Russian Federation, as well as exemptions from criminal liability.
